MESHFALL Terms of Service & Absolute Waiver of Liability

MESHFALL is an autonomous, decentralized radio frequency experimentation platform conceived, authored, and hosted as an uncompensated public contribution by Truck Guy Upfitters LLC ("The Authors", "Maintainers", "Operators", and "Hosts"). You acknowledge and irrevocably accept that you possess zero legal, equitable, or proprietary entitlement to platform continuity, uptime, service, scoring, account status, territorial boundaries, or network connectivity.

The Authors and platform operators explicitly reserve the absolute, perpetual, and unreviewable unilateral authority, exercisable at any time, for any reason or no reason whatsoever, and without notice or monetary liability, to:

• Modify, terminate, suspend, reset, or permanently wipe any operator account, dossier, score, telemetry record, or tombstone vault;
• Alter, invalidate, recalculate, or annul any territorial polygon, expansion corridor, outpost registration, or faction standing;
• Blacklist, mute, ban, or disconnect any operator callsign, public cryptographic key, IP address, MAC address, or hardware node;
• Restructure, alter, or retire game rules, state machine logic, scoring models, and governance parameters;
• Terminate the entire platform, its servers, APIs, databases, and radio relays permanently without recourse.

No advice, documentation, wiki article, terminal readout, or verbal statement shall create any warranty or operational duty not expressly written herein.

This perpetual exculpation applies without limitation to:

1. Any hardware damage, radio burnout, battery rupture, lightning strike, weather destruction, antenna tower collapse, or vehicular electrical fault incurred while building, installing, or deploying field nodes;
2. Any property trespass, physical bodily injury, vehicular accident, animal encounter, or criminal confrontation occurring during operator fieldwork, node surveying, or gateway maintenance;
3. Loss of profits, loss of data, loss of cryptocurrencies, transmission interception, privacy exposure, or cryptographic recovery key loss;
4. Any interruption, outage, failure of MQTT ingestion, database corruption, or unauthorized cyber intrusion.

In no event shall the total aggregate liability of the Authors and Operators exceed the sum of ZERO UNITED STATES DOLLARS ($0.00 USD).

You agree to fully defend, indemnify, and hold harmless Truck Guy Upfitters LLC, its affiliates, agents, directors, system administrators, and peer operators from and against any and all third-party claims, government investigations, citations, damages, fines, judgments, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your access, use, or inability to use the MESHFALL tactical grid;
• Your deployment, physical positioning, or RF transmission of hardware nodes, gateways, or antennas;
• Your violation of any federal, state, or municipal law, FCC regulation, radio spectrum limit, or private property rights;
• Your breach of any covenant or representation within these Terms of Service.

You assume sole and exclusive legal, technical, and regulatory responsibility for all radio frequency transmissions generated by hardware nodes registered to your operator callsign or hardware identifiers. You affirmatively represent and warrant that:

• All equipment operates in strict compliance with United States FCC Title 47 CFR Part 15 (ISM Band 902–928 MHz), Part 97 (Amateur Radio Service), or corresponding telecommunication authority rules in your operating jurisdiction;
• Your transmission power (EIRP), antenna gain, frequency hopping spread spectrum (FHSS) profile, and duty cycle parameters adhere to statutory ceilings;
• You will never utilize the MESHFALL network to transmit unlawful, encrypted-on-amateur-bands, jammer, emergency interference, or unauthorized public-safety signals.

Field deployment of radio telemetry nodes entails inherent hazards, including rooftop falls, electrical line proximity, lightning exposure, extreme climate exposure, and wildlife encounters. You warrant that you are voluntarily assuming all physical, mechanical, and environmental hazards associated with field scouting, off-grid mounting, solar installations, and tower ascension. You shall hold the Authors and Platform Operators harmless from any personal injury or death.

Any dispute, controversy, or claim arising out of or relating to this platform, software, or Terms of Service shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court.

This agreement shall be governed by, and construed in accordance with, the laws of the State of Ohio, United States of America, without regard to its conflict of law principles.

When you click "I Agree" or execute cryptographic registration, an immutable audit event is recorded capturing the document version (2026-09-20.1), an ISO-8601 UTC timestamp, and a keyed HMAC-SHA256 hash of your client IP address. This cryptographic entry serves as conclusive evidence of your mutual assent under the federal ESIGN Act (15 U.S.C. § 7001) and the Uniform Electronic Transactions Act (UETA).

If you request account deletion, MESHFALL executes a zero-knowledge purge. An encrypted restoration voucher is generated using client-side AES-256-GCM. The platform retains zero copies of your decryption key. You bear sole custodial responsibility for safeguarding your master recovery key.
